The Subdivision and Development Appeal Board is a quasi-judicial tribunal that hears appeals regarding decisions made by Strathcona County's subdivision authority and development authority, and renders decisions based on the evidence presented.  The Subdivision and Development Appeal Board is independent from Strathcona County and is comprised of citizen members.  More information about the Subdivision and Development Appeal Board, including Notices of Hearings for upcoming appeal hearings and meeting information, can be found here.

Considering an appeal

An appeal can be filed for a decision of the Strathcona County subdivision authority concerning a subdivision application, a decision of the Strathcona County development authority concerning a development permit application, or a stop order issued by the Strathcona County development authority.  To determine whether you have the right to appeal, please refer to the Municipal Government Act .

Filing an appeal

To file an appeal to the Subdivision and Development Appeal Board, your completed Notice of Appeal form (715.6 KB) (including the reasons for appeal) and the filing fee must both be received by the Subdivision and Development Appeal Board no later than the final date for appeal as specified in the Municipal Government Act . The Notice of Appeal form includes instructions for filing the Notice of Appeal and paying the filing fee.

After an appeal is filed

Once an appeal is filed with the Subdivision and Development Appeal Board it will be scheduled for a hearing within 30 days.  At least 5 days' notice of the hearing will be given  to those persons specified in the Municipal Government Act .  

Appeal decisions

In accordance with the Municipal Government Act , the Subdivision and Development Appeal Board will give its decision in writing together with reasons for the decision within 15 days after concluding the hearing.  If you are not a party to an appeal, you may contact the Secretary of the Subdivision and Development Appeal Board to request a copy of the decision.  

Further recourse

An appeal lies to the Court of Appeal on a question of law or jurisdiction with respect to a decision of the Subdivision and Development Appeal Board pursuant to section 688 of the Municipal Government Act .  It is recommended that you consult with legal counsel if you are considering an appeal to the Court of Appeal.
